By placing an order with Félicité ("Félicité", "we", "us" or "our") of products that are sold on the Site ("Products"), it will be considered that you have read, understood and accepted these terms and conditions of sale of products online ("Terms and Conditions of Sale"). Please read them carefully and, if you are not satisfied with their content, we advise you to contact our Customer Service before placing any order with us.

We may make changes to these Terms and Conditions at any time. To know the date of the last update of the present General Conditions of Sale, please refer to the top of the page. Whenever you order Products from us, the Terms and Conditions in force at the time of the order will apply to the contract between you and us. If we need to change these Terms and Conditions of Sale and if this significantly affects your order, we will contact you to let you know what the changes are in good time and how to cancel the contract if you are not happy with them.

Eligibility

To make a purchase through the Website or to use any of the services or features we make available to you on the Website, you will need to create an account. When you register, you will be required to provide us with information about yourself, including your name, telephone number and e-mail address, which must be accurate, current and complete in all respects. If any of the information you provided during registration changes, you will be required to modify your online account immediately. We may make changes to the registration terms at any time. In addition, you will be required to provide credit card information when placing an order. You represent and warrant that the credit card information provided with any order is both valid and correct and that you are the person whose name appears on the billing documents submitted.

The purchase of Products via the Website is strictly limited to persons who can legally enter into contracts on the Website in accordance with French law.

Pricing Policy

We have taken great care in the preparation of the content of this Website, in particular to ensure that the details, descriptions and prices given at the time of posting are accurate. However, we will only accept orders if there are no significant errors in the description of the Products or their prices as they appear on the Website. All prices include VAT and exclude delivery charges. The total amount of your order is the amount of the Products ordered plus the VAT at the then current rate and the delivery charges mentioned during the payment process.

We do not debit your bank account until we have shipped your order. The prices of the products in your shopping cart will always be the same as the most recent prices as shown on the page containing the detailed information of the Products.

Please note that no VAT exemption will be made for an online order. We invite you to contact us for any additional information.

Availability

All Products are subject to availability. The prices as shown on our Website will apply as long as the Products are available or for any period stated on the Website. We will notify you as soon as possible if the Products you have ordered are not available.

Order Errors

You may correct any order errors until you click the "Place Order" button (or equivalent) on the last page of the order process.

Confirmation and acceptance of your order

We will email you an order confirmation containing an order number as soon as possible. If we are unable to fulfill your order after confirming it, we will notify you by e-mail or telephone. We will confirm the acceptance of your order in an email that the products have been shipped ("Shipping Confirmation"). A legally binding contract between you and us will be formed when the Dispatch Confirmation is sent (or, in the unlikely event that, due to a processing error, no Dispatch Confirmation has been sent, when we dispatch the Products) ("Contract"). If you wish to obtain information regarding your order, please write to us at contact@felicite-paris.com and include your order number. We may refuse your order if the product you wish to purchase is no longer in stock, if we have identified an error with an item or if we are unable to obtain authorization for your payment.

Pre-order

In case of shortage of available stocks or refusal of payment authorization by banking institutions, Félicité reserves the right to cancel or suspend any pre-order until it is shipped. The express delivery option is not available for a pre-order.

Delivery

Deliveries can only be made in metropolitan France (including Corsica and Monaco but excluding overseas France). Our delivery methods may not all be available in the whole of France. If you have any questions regarding delivery outside of France, we recommend that you contact our Customer Service Department at +33 (0)1 75 43 25 63

 We deliver the Products in accordance with the delivery method you have chosen. When used, the term "business day" excludes Saturdays, Sundays and public holidays. Upon delivery of the Products, we will provide you with sufficient information to enable you to exercise your statutory right of withdrawal and to enable you to address any withdrawal request to the appropriate recipient or to return the Products. For more information, please see the sections on returns and right of withdrawal in these Terms and Conditions.

If offered, free delivery will only apply to standard delivery. Delivery within 24 hours, express delivery and international delivery are excluded from this offer. We will make every effort to deliver the Products ordered within 2 to 8 working days from the date of conclusion of the Contract.

Inspection

You must inspect the Products on receipt and check that everything mentioned on the delivery note is present. We will consider that you have accepted the order unless you notify us otherwise (and return the Products to us in accordance with your right of withdrawal or any other legal right (as set out in clauses 11 and 12 below).

Your Rights of Withdrawal

As a consumer, you have the legal right to withdraw from a Contract within 30 days of delivery of the Products. This means that during this period, if you change your mind or decide, for whatever reason, that you do not wish to keep a Product, you can notify us of your decision to cancel the Contract and receive a refund. Your right to return Products to us applies to Products on sale.

Your right to return items to us does not apply to Products that (i) are manufactured to your specifications; or (ii) have been visibly customized; or (iii) by their nature are not returnable or are likely to deteriorate or expire quickly; or (iv) are packaged and not returnable for protective or hygienic reasons, if unpacked upon delivery.

To cancel a Contract, simply return your order with the completed return form and the prepaid label already included in your package.

If you send us a postal mail or an e-mail, please include information about your order to help us identify it.

If you withdraw within 30 days from the date of delivery of the products:

 (a) You must return them to us as soon as possible (in the original, unopened packaging) and no later than 14 days from the day on which you notified us of your wish to cancel;

(b) The Products must be returned to us with the return slip using the pre-paid return label available in your order;

 (c) Customers wishing to return Fragrance Products must comply with the applicable labeling and packaging guidelines established by the Postal Service or other shipping service used;

 (d) If sending by mail, we recommend that you request proof of shipment as we assume no responsibility for Products lost in transit;

(e) We will refund the price of the Products. (e) We will refund the price of the Products to you, but please note that your refund may be reduced to take account of any devaluation of the Products if you have handled them in an unauthorised manner.

(f) We will refund the delivery charges you have paid, although, as permitted by law, the refund is offered under our Refund Policy.

(g) If you cancel your order but do not return the Products to us within 14 working days of notification of your wish to cancel the order, we shall be entitled to retain the refund amount.

Your other rights regarding the return of Products

Please remember that when we accept your order for products on this website, you are entering into a legally binding contract.

 We are committed to delivering to you Products that conform to those you have ordered. As a consumer, you have rights under the law if the Products are defective or not as described.

In particular, we are subject to the legal warranty conditions set forth in Articles L. 217-4, L. 217-5 and L. 217-12 of the Consumer Code and Articles 1641 and 1648 of the Civil Code.

These rights (which are generally summarized below) do not affect your right to choose to return the Products and obtain a refund under clause 11 above or to avail yourself of any other clause herein.

If the Products do not conform, you may refuse to accept them on delivery or return them to us in their original packaging, indicating the reason for refusal on the delivery note or invoice, at our expense.

You may request the repair of the Products or a new delivery in accordance with your order. If repair and replacement are not possible, you may request the cancellation of the Contract and the refund of the sums paid or keep the Products and request a reduction in their price. We will answer you as soon as possible.

Under certain conditions, you can, in accordance with the law, exercise a warranty against hidden defects, or make use of a possible commercial warranty applicable to your order.

However, we shall not be liable if the non-performance of the Contract or its improper performance is due to an action on your part, to an unforeseeable and insurmountable act of a person unrelated to the Contract (our service providers are not considered as such), or to a case of force majeure.

Our liability to you for loss or damage

We are liable to you for foreseeable loss or damage caused by us. If we fail to comply with the provisions hereof, we shall be liable to you for any loss or damage suffered by you which is the foreseeable result of our failure to comply herewith or of our failure to perform a duty which you could reasonably expect to be performed by a professional. Losses or damages are foreseeable either if it is obvious that they will occur or if, at the time of entering into the Contract, we and you knew that they were likely to occur, for example if you raised them with us during the sales process.

We do not exclude or limit in any way our liability to you if this is contrary to law. This includes liability for death or personal injury caused by our negligence or that of our employees, agents or subcontractors.

We only supply Products for domestic and private use. You agree not to use the Products for any commercial, business or resale purposes and we will not be liable to you for any loss of profits, loss of business, business interruption or loss of business opportunities.

 If, after having contacted us and at the end of the complaint procedure, you still feel that your complaint has not been resolved satisfactorily, you can call upon a mediator free of charge in accordance with Article L. 612-1 of the Consumer Code.

You can also use the Online Dispute Resolution platform set up by the European Commission.

Transfer of Rights

We may transfer our rights and obligations hereunder to another legal entity and we will always notify you in writing if this is the case but it will not affect your rights and obligations hereunder. You may only transfer your rights and obligations hereunder to another person if we have agreed to do so in writing.

Governing Law, Jurisdiction and Language

The Website, any content on it and any contract entered into as a result of its use are governed by French law. The parties agree to submit any dispute to the exclusive jurisdiction of the courts of Paris, France. All contracts are concluded in French.
